The court ordered that if the surgery was not performed on January 24, Sengar would have to surrender in jail the same day. The court further ordered that a Delhi Police constable be deployed outside Sengar’s ward at AIIMS. The court has directed him to surrender on January 27. The court made it clear that needless to say no further extension will be given. This is the second case of Sengar being released on medical bail.

The court had initially granted Sengar interim bail on medical grounds till December 20, 2024, pending medical assessment of his condition by AIIMS. Subsequently, the medical bail was extended by 4 weeks till 20 January, with the comment that no further extension would be given. Sengar had surrendered before Tihar Jail authorities on January 20 after his medical bail expired. Following this, he again moved the court regarding the cataract surgery. He asked for the sentence to be suspended for 30 days for the process.

Sengar’s advocate Manish Vashishtha said Sengar’s eyes needed immediate attention. The court was told that he had a retinal problem which required immediate cataract surgery and laser therapy. Advocate Mahmood Pracha, appearing for the complainant, opposed the application seeking interim bail. He said that the court had earlier also refused to extend his medical bail.

Justice Chawla said even if the court had refused to extend the bail, there would be no problem if it was allowed. He can surrender back on the same day. Meanwhile, Sengar’s plea seeking suspension of sentence in the case of custodial death of the victim’s father was also listed for hearing today. Justice Vikas Mahajan gave time to the victim’s lawyer to respond to the petition. The court said that it is not in favor of postponing the hearing of the case.
